These Terms & Conditions (“Terms”) apply to your use of websites, funnel pages, digital products, downloads, AI-supported tools, memberships, waitlists, email communications, and services operated by Catching Excellence Ltd, trading as Catching Sparks Digital.

By accessing our websites, signing up for a free resource, joining a waitlist, purchasing a product, or using any of our digital products or AI-supported tools, you agree to these Terms.

In these Terms, “we”, “us” and “our” means Catching Sparks Digital.

Catching Sparks Digital operates digital product brands including, but not limited to:

  • other related digital products, tools, brands, and offers operated by us

2. What we provide

We create and sell digital products, resources, AI-supported tools, custom prompt experiences, digital downloads, templates, memberships, and related services.

Our products may include:

  • downloadable PDFs, checklists, workbooks, rituals, resets, or guides

  • email-based resources or sequences

  • access to AI-supported tools or custom GPT-style experiences

  • digital planning, reflection, or accountability tools

  • memberships, beta access, founder access, or online communities

  • paid digital programmes or premium support services

Product details, pricing, and access terms will be shown on the relevant sales page, checkout page, or product description at the time of purchase.

3. Eligibility

Our websites, products, and services are intended for adults aged 18 and over.

By using our websites or purchasing from us, you confirm that you are at least 18 years old and legally able to enter into a contract.

4. Free resources and waitlists

We may offer free resources, downloads, checklists, rituals, resets, or waitlists in exchange for your name and email address.

When you sign up, we may send you:

  • the requested resource

  • follow-up emails related to that resource

  • product updates

  • founding access invitations

  • relevant educational or promotional emails

You can unsubscribe from marketing emails at any time using the unsubscribe link in our emails.

5. Purchases and payment

Prices are shown on the relevant sales page or checkout page.

Unless stated otherwise:

  • prices may be shown in GBP, USD, or another stated currency

  • payment is due at checkout

  • access is provided after successful payment

  • prices may change at any time

  • promotional prices, founder prices, or launch prices may be withdrawn without notice

Payments may be processed by third-party providers such as Stripe, PayPal, GoHighLevel, or similar checkout providers.

We do not usually store your full card details ourselves.

6. Digital product access

After purchase, you will receive access to the relevant digital product, download, membership, or tool according to the instructions provided at checkout or by email.

You are responsible for ensuring that the email address you provide is correct.

We may update, improve, replace, or retire parts of a product over time, especially for beta, founder, or AI-supported products.

7. Digital content and cancellation rights

Some of our products are digital content supplied immediately after purchase.

Where required by law, before accessing an immediate digital download or digital product, you may be asked to confirm that:

  • you agree to receive the digital content immediately; and

  • you understand that you may lose your 14-day right to cancel once access or download begins.

For UK consumers, GOV.UK explains that businesses supplying downloads or streaming services must get the customer’s agreement to instant access and acknowledgement that they lose the 14-day right to cancel once the download or access starts.

This does not affect your statutory rights if the digital content is faulty, not as described, or not provided with reasonable care.

8. Refund policy

Because many of our products are digital and may be accessed immediately, refunds are not automatically provided once access has been granted, unless required by law or stated otherwise on the relevant sales page.

We may consider refund requests at our discretion where:

  • you were charged in error

  • you purchased the wrong product and have not accessed it

  • there is a technical issue we cannot reasonably resolve

  • the product was materially not as described

Nothing in these Terms limits your statutory consumer rights.

9. Subscriptions and memberships

If you purchase a subscription:

  • your subscription continues until cancelled

  • you are responsible for cancelling before the next billing date if you do not wish to continue

  • access may end when your subscription ends

  • we may change subscription pricing or features with reasonable notice

Cancellation instructions will be provided through the relevant checkout, customer portal, or support process.

Refunds for subscription payments already taken are not guaranteed unless required by law or stated otherwise.

10. Founder access, beta products, and early-stage offers

Some products may be sold as founder access, beta access, early access, or test offers.

These products may be incomplete, evolving, or subject to change.

By joining a founder or beta offer, you understand that:

  • the product may change based on feedback

  • features may be added, removed, renamed, or refined

  • access may be delivered through temporary platforms or third-party tools

  • the product may not yet represent the final version

  • your feedback may be used to improve the product

Founder or beta pricing may be limited and may change later.

11. AI-supported tools and outputs

Some products include AI-supported tools, prompts, chatbots, custom GPT-style experiences, or automated guidance.

AI outputs may be:

  • incomplete

  • inaccurate

  • outdated

  • unsuitable for your personal circumstances

  • inconsistent

  • based on the information you provide

You are responsible for reviewing and applying any AI-generated output with your own judgement.

Our AI-supported products are designed for educational, reflective, planning, organisational, spiritual, accountability, or self-support purposes only. They are not a substitute for professional advice.

You should not rely on AI-generated output as medical, legal, financial, psychological, nutritional, therapeutic, or other regulated professional advice.

12. Product-specific disclaimers

Retain Rhythm

Retain Rhythm provides non-medical habit, routine, reflection, and accountability support.

It does not provide:

  • medical advice

  • nutritional advice

  • psychological advice

  • medication advice

  • eating disorder treatment

  • weight-loss treatment

  • diagnosis, prevention, or cure of any condition

Always speak with a qualified healthcare professional about medication, weight management, eating concerns, mental health, or medical decisions.

AskAndAbound / manifestation-related products

AskAndAbound and related manifestation or mindset products are for reflection, personal development, journaling, and educational purposes only.

They do not guarantee:

  • financial results

  • business results

  • income

  • manifestation outcomes

  • personal transformation

  • professional success

You are responsible for your own decisions and actions.

Mystic Exhale / spiritual products

Mystic Exhale and related spiritual or ritual products are for personal reflection, spiritual exploration, ritual support, and self-connection.

They do not provide medical, psychological, therapeutic, financial, legal, or professional advice.

Any spiritual, intuitive, ritual, oracle-style, or reflective content is for personal use and entertainment/reflection purposes only.

Full Brain Days

Full Brain Days and related planning or capacity products are for organisation, reflection, planning, and self-support.

They do not provide medical, psychological, occupational health, productivity diagnosis, therapy, or professional advice.

13. No guarantees

We aim to provide useful, high-quality digital products and tools.

However, we do not guarantee:

  • specific results

  • income

  • business growth

  • habit change

  • weight maintenance

  • emotional outcomes

  • spiritual outcomes

  • productivity outcomes

  • health or wellbeing outcomes

  • uninterrupted access

  • that a product will suit every user

Your results depend on many factors, including your circumstances, actions, consistency, environment, and external conditions.

14. Your responsibilities

You agree to use our websites, products, and tools responsibly.

You must not:

  • use our products for unlawful purposes

  • share login details or paid access with others

  • copy, resell, redistribute, or commercially exploit our products without permission

This includes but is not limited to:

  • rituals

  • resets

  • prompt packs

  • digital dashboards

  • email content

  • product frameworks

  • brand assets

  • videos

  • audio files

  • AI prompt structures

  • custom tool instructions

When you buy or download a product, you receive a personal, non-exclusive, non-transferable licence to use it for your own personal or internal business use, unless we state otherwise in writing.

You may not resell, share, licence, reproduce, distribute, or modify our products for commercial purposes without written permission.

16. User feedback and testimonials

If you send us feedback, comments, testimonials, reviews, survey responses, or product results, you allow us to use them for product improvement and marketing, unless you tell us otherwise.

We will seek permission before using identifiable testimonials publicly where appropriate.

We do not use fake reviews or testimonials.

17. Third-party platforms and links

Our products and websites may use or link to third-party platforms, including but not limited to:

We are not responsible for the availability, security, content, policies, or performance of third-party platforms.

Your use of third-party platforms may be subject to their own terms and privacy policies.

18. Account access and security

If a product requires account access, login details, or a private link, you are responsible for keeping that information secure.

You must not share paid access with others unless the product specifically allows it.

We may revoke access if we suspect misuse, unauthorised sharing, fraud, or breach of these Terms.

19. Availability and changes

We aim to keep our websites, products, and tools available, but we do not guarantee uninterrupted or error-free access.

We may:

  • update products

  • change features

  • fix issues

  • pause access for maintenance

  • retire products

  • change platforms

  • discontinue beta tools

  • update pricing

  • modify these Terms

Where practical, we will give reasonable notice of significant changes that affect paid access.

20. Limitation of liability

To the fullest extent permitted by law, we are not liable for:

  • loss of profits

  • results not achieved from using our products

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.

21. Indemnity

You agree to indemnify and hold us harmless from claims, losses, damages, liabilities, costs, or expenses arising from:
